Conspiracy
Often times in a drug related offense the defendants are charged with a separate substantive offense, Conspiracy. In general the elements of a conspiracy are the combination or agreement, which can be expressed or implied, between two or more persons to commit an illegal act or a legal act in an illegal manner.

In Michigan, there is a statute on conspiracies. The actual crime of conspiracy is a distinct and different crime from the substantive offense. Whether a defendant is successful in completing the crime is not required to be convicted of conspiracy. Nor is it neccessary that all defendants participate in the conspiracy throughout the entire criminal endeavor.

For example, in a conspiracy involving a drug case, not all the individuals along the chain need to know all the conspirators, or all the details of the conspiracy in its entirety. In other words if A and B agree to drive the get away car in a drug deal for C and D, who agree to sell drugs to E, they all could be prosecuted for a conspiracy.

A police informant willing to pretend to participate in an alleged criminal enterprise such as delivery of a controlled substances is not a co-conspirator in the alleged conspiracy.
